What’s the difference between simple, advanced and qualified e-signatures, and why is it important?

The terms simple, advanced, and qualified electronic signatures come from the e-signature regulation eIDAS, which applies to the use of digital signatures in the EU and UK. 

Simple e-signatures are the main type of signature that Docusign provides as standard across most of their plans. This type of signature does not follow any additional security or identity verification measures, so an act as basic as ticking a checkbox or signing off an email can count as a simple signature. It is this lack of security that means simple e-signatures are not legally binding. 

Advanced e-signatures meet specific criteria set out in eIDAS that ensure the signature is legally binding with tamper-proof evidence and a full audit trail. This confirms the signer is who they say they are and proves their intent to agree to the contents of the document. 

Qualified e-signatures are the most secure type of signature as established in eIDAS. They are typically best suited to highly regulated industries such as banking and finance. As well as meeting the requirements for advanced signatures, qualified signatures have to meet additional criteria in order to be issued with certification. The identity verification process for these types of signatures is multi-step, using both two-factor authentication and encrypted keys.
